These Terms and Conditions explain the rules for using the Spade Himalaya website and for booking a trek or tour with us. They form an agreement between you and Spade Himalaya (“we”, “us”, or “our”). So please read them before you book. When you book a trip, you accept these terms.

Booking and payment
To book, you give us accurate personal details, your passport details, and any health information we ask for. You also confirm that you are fit enough for your chosen route.
We ask for a deposit to secure your booking. Then the balance is due before your trip starts. You can pay by card, bank transfer, or another approved method. We will tell you the exact deposit amount, the due dates, and the payment options when you book. After we receive your payment, we send you a confirmation by email.
Prices and what is included
Each trip page lists what is included and what is not. In general, your price covers your licensed guide, your trekking permits, and the services shown on your trip page. It does not cover international flights, your Nepal visa, travel insurance, tips, or personal expenses, unless we say otherwise. Prices can change before you book, for example if fees or taxes change. Once you book and pay your deposit, we hold your price.
Changes you ask for
You can ask to change your trip, such as the dates or the route. So we will try to help where we can. Still, changes depend on what is available, and they may cost more. Please ask us as early as you can.
If you cancel your trip
If you need to cancel, please tell us in writing. Your refund then depends on how many days are left before departure.

We suggest travel insurance that covers cancellation, so you are protected if your plans change.
If we change or cancel your trip
Your safety comes first. So we may change a route, a date, or a plan if conditions require it. In rare cases, we may cancel a trip, for example for safety or for events beyond our control. If we cancel, then we offer you another date or a fair refund for the services we did not provide. We are not responsible for other costs you booked on your own, such as flights.
Travel insurance
Travel insurance is required for every trek with us. Your policy must cover medical care, emergency helicopter evacuation, high-altitude trekking, accidents, trip cancellation, and lost luggage. Also, we may ask to see your policy before your trip starts. If you do not have valid insurance, then we may not be able to take you on the trek.
Your health and fitness
You must tell us about any medical condition before you book. For hard or high routes, we may ask for a doctor’s note. So this keeps you and the group safe. If you hide important health information, then we may cancel your trip without a refund, and you accept the risk that follows.
The risks of trekking
Trekking and mountain travel carry real risks. These include accidents, illness, injury, and altitude sickness. Many routes are remote, so medical help and rescue can take time. So you join your trip voluntarily, and you accept these risks. Your guide may change the route, slow the pace, or turn back for safety. You agree to follow your guide’s safety decisions.
Our responsibility and its limits
Also, we take real care to plan and run your trip well. Still, we are not liable for loss, injury, or delay that is outside our control, or that comes from your own actions or from the risks of trekking. Where we are liable, our responsibility is limited to the cost of your trip, except where the law says otherwise. Nothing in these terms removes any right you have under the law.
Passports, visas, and permits
You are responsible for a valid passport and the correct Nepal visa. We arrange your trekking permits, so you must give us accurate passport details in good time. If wrong details cause a delay or a permit problem, then we are not responsible for the result.
Conduct on the trip
Please follow your guide’s instructions at all times. Also, respect local customs, the environment, and wildlife. Illegal drugs are not allowed, and excessive alcohol is not allowed on the trail. If your behaviour puts people or the trip at risk, then we may remove you from the trip without a refund. In that case, you also cover any extra costs.
Events beyond our control
Sometimes events outside our control affect a trip. These include bad weather, flight delays or cancellations, landslides, earthquakes, floods, fire, war, civil unrest, strikes, epidemics, and government action. So we are not liable for these events. Still, we will help you find the best safe alternative.
Complaints
We want every trip to go well. So if something is wrong, please tell your guide at once, so we can try to fix it on the spot. If we cannot solve it on the trail, then please contact us within 28 days after your trip ends. We will look into it and reply.
Website content
The content on our website, such as text, images, and logos, belongs to Spade Himalaya or our partners. So please do not copy or reuse it without our written permission.
Privacy
We handle your personal data as set out in our Privacy Policy. Please read it together with these terms.
Governing law and disputes
These Terms and Conditions are governed by the laws of Nepal. If a dispute comes up, then we will first try to settle it through mediation or arbitration in Nepal. Any matter that remains will be handled by the courts of Nepal.
